These Terms of Service apply to the use of our website and to booking our boat trip and car rental services. By making a booking or using our services you accept these terms.

1. General and Scope

These terms apply to all agreements between the provider and the customer regarding boat trips and car rental. If any provision of these terms is invalid, the remaining provisions remain in force.

3. Description of Services

We offer guided boat trips and cruises from the port of Fuengirola, and passenger car rental in the Costa del Sol area. The exact content, duration and prices of the services are stated at the time of booking.

4. Booking and Formation of Contract

Bookings are made via the booking form on the website or by another separately agreed method. A binding contract is formed once we have confirmed your booking by email. The customer is responsible for the accuracy of the information provided.

5. Prices and Payment

Prices are stated at the time of booking and include the applicable value added tax. Payments are processed securely via our payment provider (Stripe). A booking can only be confirmed once the payment or agreed deposit has been made.

6. Cancellations and Refunds

Cancellation terms depend on the service and the time of cancellation:

  • Customer cancellation: please notify us as early as possible. Cancellation and refund terms are stated at the time of booking.
  • Weather cancellations (boat trips): if a trip is cancelled for safety reasons or due to weather conditions, we offer a new date or a full refund.
  • Provider cancellation: if we have to cancel a service, you receive a full refund or a replacement date.

7. Customer Responsibilities

  • Arrive at the agreed time; lateness may result in loss of the booking without a refund
  • Follow the safety instructions given by staff and the captain
  • Provide accurate and up-to-date contact details
  • Be liable for any damage they cause

8. Specific Terms for Boat Trips

  • For safety reasons, the captain may modify or interrupt a trip due to weather or sea conditions
  • Children are the responsibility of their guardian throughout the trip
  • Use of life jackets and the instructions given is mandatory where required
  • Persons under the influence of intoxicants may be refused participation without a refund
  • Inform us in advance of any health restrictions (e.g. pregnancy, heart condition)

9. Specific Terms for Car Rental

  • The renter must hold a valid driving licence and meet the minimum age requirement
  • A security deposit may be charged for the vehicle, refundable when the car is returned in the agreed condition
  • The fuel policy and permitted mileage are stated at the time of rental
  • The customer is liable for any damage, fines and traffic offences during the rental period in accordance with the insurance terms
  • The car must be returned at the agreed time and place; late returns may incur an additional charge

10. Limitation of Liability

The provider is not liable for indirect damages or for damages arising from force majeure, the customer's own conduct or failure to follow instructions. Our liability is in all cases limited to the price paid for the service, unless mandatory law provides otherwise.

11. Force Majeure

We are not liable for delays or failure to perform caused by events beyond our control, such as exceptional weather conditions, natural phenomena, strikes or official orders.

12. Intellectual Property

The website content, images, logos and other material are the property of the provider or its licensors. Copying or using the material without permission is prohibited.

13. Privacy

The processing of personal data is described in a separate Privacy Policy, which forms part of these terms.

14. Applicable Law and Dispute Resolution

The contract is governed by Spanish law as the country where the service is performed, unless mandatory consumer protection law provides otherwise. A consumer customer may bring a dispute before the consumer dispute body of their home country or the EU Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms of Service. The current terms are published on this page. The terms in force at the time of booking apply to that booking.
